Former President Donald Trump (the legitimate President in the eyes of many) on Saturday said he expects to be indicted tomorrow by New York’s Far Left Soros-backed Manhattan District Attorney Alvin Bragg. (Bragg received approximately $1 million from Soros in his election.)
Bragg campaigned on “getting” Donald Trump, as did New York’s Democrat Attorney General Leticia James, so the notion that the expected indictment isn’t political is absurd on its face. However, the novelty of Democrats actually fulfilling a campaign promise requires us to give a brief analysis of the theory of the case and likely charges.
According to multiple media reports the charges will be felony campaign finance violations related to the payments to “Stormy” Daniels, the sometime stripper and porn actress, with whom Mr. Trump allegedly had a liaison in 2006.
A decade later, during the 2016 presidential campaign, Daniels allegedly approached an intermediary and demanded a payoff in return for keeping quiet about the salacious details of her “relationship” with Trump.
According to reporting by Michael Rothfeld of the New York Times:
The Manhattan district attorney, Alvin L. Bragg, has signaled he is preparing to seek felony charges against Mr. Trump; Mr. Bragg is expected to accuse him of concealing a $130,000 hush-money payment that Michael D. Cohen, Mr. Trump’s lawyer and fixer, made to Ms. Daniels on the eve of the 2016 presidential election.
A conviction would be likely to hinge on prosecutors’ proving that Mr. Trump reimbursed Mr. Cohen and falsified business records when he did so, possibly to hide an election law violation.
Capable lawyers with whom we have communicated have suggested this might be the first time in New York a victim of blackmail has been indicted for agreeing to the payoff, furthermore, the witnesses against Mr. Trump appear to be his former attorney Michael Cohen, who was sent to prison for crimes unrelated to his representation of Mr. Trump, and the blackmailer herself, Stormy Daniels.
And as Mr. Rothfeld further reported:
It would not be a simple case. Prosecutors are expected to use a legal theory that has not been assessed in New York courts, raising the possibility that a judge could throw out or limit the charges. The episode has been examined by both the Federal Election Commission and federal prosecutors in New York; neither took action against Mr. Trump.
Our friend attorney Mike Davis, who heads the Article III Project and once served as a clerk for now-Supreme Court Justice Neil Gorsuch and as chief nominations counsel for the Senate Judiciary Committee put it this way in a tweet:
So, will the indictment presumably coming tomorrow really guarantee a Trump victory in 2024?
Mike Davis is not the only smart guy who thinks it will. Elon Musk tweeted his take as soon as the news broke:
From our perspective this is a textbook case of politicizing prosecutorial power, as outsider Republican presidential candidate Vivek Ramaswamy said, Bragg campaigned on getting Donald Trump and now he’s fulfilled his campaign promise. The argument that Trump shouldn’t be “above the law” is a straw man: the only reason that Bragg is even considering this case is because it’s Trump.
Many Republican leaders, including Speaker of the House Kevin McCarthy, Mr. Ramaswamy and other Republican presidential candidates – or presumed to be candidates – have called out this witch hunt and urged Bragg to abandon the plan to indict President Trump.
But there’s also another angle to consider after the Whitmer “fed-napping case” and the January 6 “fed-surrection” at the Capitol: What if this isn’t so much about Trump’s alleged crimes as it is another provocation intended to incite violence against the regime?
Former President Trump called for nationwide protests if he is indeed indicted and social media is already awash in calls for demonstrations against the indictment. What if this is a provocation intended to give a fig leaf to the Democrats’ oft expressed desire to further crackdown on Trump supporters and the MAGA Movement?
At the precise time when our constitutional process for choosing presidential candidates is about to kick-off and test whether the public really wants Donald Trump back in the White House, only Far Left Democrats like Alvin Bragg could be stupid and arrogant enough to turn Donald Trump into Nelson Mandela – an imprisoned martyr and rallying point for revolutionaries.
Or maybe they are not so stupid, and they are counting on us to be dumb enough to take the bait and make tomorrow into another “fed-surrection.”
Don’t take the bait, especially if you live in a jurisdiction controlled by Democrats, keep it peaceful – whether in the street or online – don’t give them the excuse they are looking for to attack you and blame another “fed-surrection” on conservatives and Trump supporters.
